RICHMOND HILL PICKLEBALL CLUB

PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK AND CONSENT

Please read this Agreement carefully before participating in any Richmond Hill Pickleball Club ("RHPC") activity.

By registering for or participating in any RHPC program, league, lesson, clinic, tournament, social event, or other activity ("Activities"), you acknowledge and agree as follows:

1. Assumption of Risk

I understand that participation in pickleball and related activities involves inherent risks, including slips, falls, collisions, equipment failure, weather conditions, physical exertion, medical emergencies, and other risks that may result in serious injury, permanent disability, or death.

I voluntarily choose to participate and freely accept all known and unknown risks associated with my participation.

2. Medical Fitness

I confirm that I am responsible for determining whether I am medically fit to participate. I will stop participating immediately if I experience illness, injury, dizziness, chest pain, or any condition that may place myself or others at risk.

3. Release of Liability

In consideration for being permitted to participate, I release and forever discharge the Richmond Hill Pickleball Club, its directors, officers, instructors, volunteers, organizers, officials, employees, contractors, sponsors, facility owners, municipalities, school boards, and all other persons acting on its behalf ("Released Parties") from any claims, demands, actions, damages, costs or expenses arising from my participation in the Activities, including claims arising from the negligence of the Released Parties, except where liability cannot legally be excluded under Ontario law.

4. Emergency Medical Care

If I require emergency medical treatment, I authorize RHPC to seek appropriate medical assistance on my behalf. I understand that I am responsible for any costs arising from such treatment.

5. Minors

If registering a participant under the age of 18, I confirm that I am the parent or legal guardian of that participant and agree to this Agreement on their behalf.

6. Photography and Media

I grant permission for RHPC to photograph or record me during club activities and to use those images or recordings for club websites, newsletters, social media, promotional materials, and other club communications without compensation.

7. Electronic Consent

I acknowledge that checking the acceptance box during online registration constitutes my legal electronic signature and confirms that I have read, understood, and voluntarily agree to this Agreement.

8. Governing Law

This Agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

9. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

• I understand that I am giving up certain legal rights, including the right to sue.

• I understand the risks associated with participating in pickleball activities.

• I voluntarily agree to all terms of this Agreement.
